Victory!
The Obama Administration recently proposed to rescind the controversial Medicaid regulations introduced in 2007. CEC and other organizations in the education and disability community had advocated for this outcome for several years. On June 1, 2009, CEC sent a letter in support of the proposed rescission. CEC anticipates these regulations will be officially rescinded in the summer of 2009, before the current moratorium is set to expire. Watch this site for the latest news.
Background
In 2007, the Centers for Medicare and Medicaid Services (CMS) issued a series of regulations that sought to eliminate Medicaid reimbursement for targeted case management, rehabilitation services, transportation, and administrative claiming for Medicaid-eligible children with disabilities. If enacted, these regulations would shift financial responsibility to states, totaling approximately $7 billion over five years.
Recognizing the dramatic impact these regulations would have on states -- including school districts and early intervention programs -- Senators Rockefeller (WV), Kennedy (MA), and Snowe (ME) and Representatives Dingell (MI) and Murphy (PA) introduced CEC-supported legislation to extend the congressionally imposed moratorium on these regulations, which were due to expire on June 30, 2008, to April 1, 2009. Congress again extended the moratorium in the American Recovery and Reinvestment Act passed on Feb. 17, 2009. This latest extension is set to expire on July 1, 2009.
