President Signs Mental Health Parity Legislation into Law

On October 3, Congress passed and President Bush signed into law legislation to require health insurance plans that offer mental health coverage to provide that coverage on par with coverage offered for physical illnesses. CEC is pleased that Congress and the Bush Administration have taken steps to addressing insurance parity for mental health coverage.

The Paul Wellstone and Pete Domenici Mental Health Parity and Addiction Equity Act of 2008 seeks to address current insurance disparities whereby many health insurance plans allow treatment for physical ailments to extend until the illness is remedied while they also limit the length of treatment permitted (i.e. 6 weeks) for mental illnesses. While this legislation intends to address many of the disparities that current exist in the insurance coverage of mental health, it does not mandate that insurance plans must provide mental health coverage. It is estimated that this legislation will improve coverage for approximately 113 million Americans.
